Indonesia: Regional Head Election Dispute Trial to Run According to the Constitutional Court’s Plan
Jakarta – The Constitutional Court (MK) ensures that the trial of the dispute over the results of the general elections for governors, regents, and mayors or the 2024 Pilkada dispute will run proportionally and on time.
Head of the Public Relations and Protocol Bureau of the Constitutional Court, Pan Mohamad Faiz, said that the handling of the Pilkada dispute will be carried out within the specified time limit, so that the election results can be ratified immediately and regional leadership can be filled immediately without prolonged delays.
“God willing, with the trial management that we have prepared carefully, we can complete it all,” said Faiz.
Faiz also explained that Constitutional Court Regulation Number 14 of 2024 has stipulated that the trial for pronouncing the final decision on the Pilkada dispute will be held on March 7-11, 2024. The schedule is adjusted to the deadline for the Constitutional Court to decide on Pilkada dispute cases.
On the other hand, the Constitutional Court registered 310 cases of 2024 Pilkada disputes. This number consists of 23 cases related to gubernatorial election results disputes, 238 regent cases, and 49 mayoral cases. According to Faiz, the Constitutional Court is accustomed to handling hundreds of cases. He gave an example, the Constitutional Court was able to adjudicate 306 disputes over the 2024 Legislative Election (Pileg) as well as disputes over Pilkada in previous years on time.
“This is not the first time the Constitutional Court has had this experience. In fact, in the last legislative election, the number was almost the same. Likewise with the Pilkada or the resolution of previous Pilkada disputes. We have always been able to resolve all of these cases even before the deadline,” said Faiz.
Meanwhile, a member of the North Maluku KPU, Mukhtar Yusuf, said that in order to maintain conducive conditions, his party appealed to the entire community to respect all decisions of the Constitutional Court. In addition, his party also emphasized its commitment to respecting the legal process for the 2024 Pilkada dispute at the Constitutional Court.
“The Constitutional Court is a channel of democracy. We respect the process in the Constitutional Court and obey what is decided,” said Mukhtar.
Mukhtar added that the dispute over the election results is part of a democratic mechanism that must be respected by all parties. He also explained that even though there were lawsuits filed, the previous 2024 elections were conducive and smooth.
“We are grateful that all stages, from voting to recapitulation, went according to the rules,” he said.
He also appealed to the public to maintain unity during the legal process at the Constitutional Court.
“Our hope is that the public will maintain conduciveness and fully submit this process to the existing legal mechanisms,” concluded Mukhtar.
