The Criminal Procedure Code Bill Answers the Challenges of Modern Law Enforcement

Indonesia, with the largest population in Southeast Asia, has a complex legal system that continues to develop following social dynamics and the demands of the times. One important aspect of the Indonesian legal system is the Criminal Procedure Code (KUHAP). The Draft Law (RUU) on the Criminal Procedure Code is a strategic step in responding to these challenges, as well as answering the public’s need for a more modern, efficient, and transparent law enforcement system.
One of the problems that is often highlighted by the Criminal Code is the procedure which is still considered complicated and tends to be slow, which has the potential to cause injustice to both defendants and victims. In addition, the rapid development of information and communication technology also requires adjustments to the legal system that can no longer rely on traditional methods.
Updating the Criminal Procedure Code is an urgent need to answer this challenge. One effort to answer this need is to design and compile a Criminal Procedure Code Bill that is more adaptive to the demands of the times, and is able to answer various increasingly complex law enforcement challenges. The Criminal Procedure Code Bill offers significant updates in several key aspects. One of them is regarding the enforcement of human rights (HAM) which is increasingly enforced in the criminal justice system.
Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman said that the drafting of the Criminal Procedure Code Bill is an important step to close the gap in human rights protection (HAM) in the Indonesian criminal justice system. The renewal of the Criminal Procedure Code must maintain a balance between strict law enforcement and respect for human rights, as well as strengthen the role of advocates in assisting suspects.
This renewal is expected to reduce the practices of torture, unlawful detention, and shorten the detention period which is often prolonged without clear legal certainty. One of the breakthroughs in the Criminal Procedure Code Bill is clearer regulations regarding detention, with stricter detention time limits and a more transparent extension mechanism.
In addition to protecting human rights, the development of information technology is also one of the focuses of the Criminal Procedure Code Bill. In this digital era, various aspects of human life are already connected to technology, including in the legal realm. The application of technology in the legal process will greatly assist in accelerating the course of the judicial process.
The Criminal Procedure Code Bill recognizes the importance of technological innovation to face the challenges of the times, especially related to digital evidence, online supervision of trial processes, and the use of applications that facilitate public access to legal information.
One of the important steps proposed in the Criminal Procedure Code Bill is the acceptance of electronic evidence in the investigation and trial process. In this increasingly digital world, cybercrime is increasing, and evidence obtained through technology is very important.
The Criminal Procedure Code Bill regulates the acceptance of electronic evidence, such as video recordings, emails, text messages, and other digital data, which can be valid evidence in the trial process. This will make it easier for authorities to handle modern crimes and speed up the resolution of cases.
In addition, the use of technology will also be expanded in the trial process, such as the implementation of online trials or video conferences for defendants who are in detention, thereby reducing the costs and time spent in carrying out trials. This will certainly be very useful, especially in remote areas that have difficulty accessing judicial centers, as well as to reduce congestion in the trial process.
Legal Figure and Activist, Gus Aan said that his party appreciated the Criminal Procedure Code Bill because it strengthened the role of prosecutors as dominus litis in the investigation process. This step will bring significant changes to the Indonesian criminal justice system, ensuring that the legal process is more transparent, accountable, and fair for all parties.
The updates in the Criminal Procedure Code Bill also focus on strengthening the function of investigators and prosecutors in maintaining the independence and quality of investigations and prosecutions. A faster and more efficient legal process is expected to reduce corrupt practices and abuse of authority in the justice system. In addition, legal accessibility for the public is also a major concern in this bill.
The new Criminal Procedure Code Bill is expected to be able to provide a faster and more appropriate response to these crimes, with a more flexible and adaptive mechanism. Thus, law enforcement officers can more quickly identify perpetrators, and accelerate the legal process related to digital crimes.
